Duty to Report

What is a CAS in Ontario?

A Children's Aid Society in Ontario is a non-profit Community Agency legislated under the Child and Family Services Act, and legally mandated to protect children under the age of 16 from abuse and neglect. CAS's in Ontario are funded by the Government of Ontario (Ministry of Children and Youth Services).

The Child and Family Services Act promotes the best interests, protection and well-being of children with key emphasis on early action, access to information and early permanency planning. The Duty to Report abuse and neglect is a key component of the act stressing that a CAS is responsible to ".....investigate allegations or evidence that children who are under the age of 16....may be in need of protection."

What is Child Abuse?

When a child is hurt intentionally, or when a parent or caregiver fails to protect a child in their care. There are several different types of child abuse including: physical, sexual, emotional and neglect.

Physical Abuse (or risk of)

  • Any deliberate physical force or action that results, or could result, in injury to a child
  • Punching, slapping, beating, pinching, shaking, burning, biting, or throwing a child
  • Stronger than what is considered reasonable discipline

Sexual Abuse (or risk of)

  • Occurs when a child is used for the sexual gratification of an adult or older child
  • Coercion (physical, psychological or emotional) is intrinsic to sexual abuse
  • Coercion distinguishes sexual abuse from consensual play with peers

It is against the law to touch a child in a sexual way, encourage or force a child to touch another person in a sexual way, encourage or force a child to participate in any sexual activity, or tell a child to touch him or herself for an adult's or older child's sexual purposes.

Emotional Abuse (or risk of)

  • Pattern of behaviour that attacks a child's emotional development and sense of self-worth
  • Includes excessive, aggressive or unreasonable demands that place expectations on a child beyond his or her capacity

Neglect

  • Failure to meet a child's basic needs including: food, clothing, shelter, sleep, medical attention, education,and/or protection from harm
  • Can occur when parents don't know about appropriate care for children or when they are not able to plan ahead
  • A young child should never be left unattended

Your Duty to Report Suspected Abuse/Neglect

  • Every Individual is obligated to report suspected abuse or neglect
  • Report is based on reasonable suspicion
  • Reasonable grounds is based on honest judgement
  • Obligation is ongoing
  • Duty cannot be delegated
